It’s Day 2 of animal cruelty investigator Zoe Rosenberg's trial, following a significant win for the defense on Day 1: the judge ruled her GPS ankle monitor can finally come off, after 20 months of being forced to wear it. This victory comes even as Zoe faces serious felony and misdemeanor charges for rescuing four chickens, that she said were seriously ill, from a Perdue-owned slaughterhouse in Petaluma. It's a trial that many consider a battle over the morality of large scale industrialized farming of animals.
Day 1 was intense — arguments flew over what evidence and testimony will be allowed. Central to the debate is Zoe’s state of mind when entering the facility. The judge has already denied the use of the necessity defense, a legal strategy that justifies lawbreaking to prevent greater harm — often used in emergencies to protect human life. The court ruled it doesn’t apply here because the danger was to animals, not people.
However, the defense is pushing another strategy: a mistake-of-law defense. They contend Zoe believed her action to rescue the chickens was lawful. Though necessity has been ruled out, the mistake-of-law defense would allow Zoe to argue that she believed what she was doing was legal.
Before entering court on Day One, Zoe gave an impassioned speech surrounded by about 100 Direct Action Everywhere supporters and some media. Many found it quite moving as you will see in the clips we will show you. The question is: will Zoe be able to make her case in the same effective way if she takes the witness stand?
What will Day 2 bring? More rulings on which parts of the case the jury will hear. And, the two sides are also wrangling over the jury questionnaire!
